Joan Rivers: Medical Negligence lawsuit planned after endoscopy goes wrong

The daughter of Joan Rivers has hired a renowned Manhattan law firm to launch a major lawsuit against the clinic where the comic went into cardiac arrest during a procedure in August.

Melissa Rivers has started the medical negligence lawsuit process with firm Gair, Gair, Conason, Steigman, Maloof, Bloom and Rubinowitz as the first step in filing a wrongful death suit against the Upper East Side clinic, Yorkville Endoscopy.

Managing partner Ben Rubinowitz then confirmed the firm’s involvement in a statement.

“In order to fully determine all the facts and circumstances surrounding the death of Joan Rivers, we confirm that our firm has been engaged by Melissa Rivers and her family,” he said, declining further comment.

While Rivers’ will has yet to be filed in court, the comedian’s daughter is expected to be named the executor of her mother’s estate and would be the legal party to sue the clinic.

The will would have to be filed and the executor empowered by a judge to act on behalf of the estate before any lawsuit can be filed.

Rivers went to the E. 93rd St. clinic on Aug. 28 to undergo an endoscopy procedure. The endoscopy was so that she could have her throat looked at “for evaluation of voice changes and gastroesophageal reflux disease,” the ME’s office said.

One media outlet, The Daily News, later reported that Rivers also underwent an unplanned biopsy on her vocal cords, performed by her private doctor, while at the clinic.

Her air supply was cut off at one point, and she went into cardiac and respiratory arrest that sent her into a coma.

Rivers, 81, died Sept. 4 at Mount Sinai Hospital.
